Program Overview

This novel evening pre-conference will feature lively discourse among experienced plaintiff and defense attorneys, with oral arguments in sample cases covering both civil and regulatory matters. Attendee participation from physicians, attorneys, nurses, administrators and other professionals will be heavily featured. Practical, real-world tips will be shared to improve quality of care, communication, and documentation, thereby reducing bad outcomes and liability exposure. The importance of expert testimony in pursuing or defending these cases will be explored, including recommendations for those serving as expert witnesses or consultants. 


Learning Objectives

At the completion of this training participants will be able to:

  1. Describe the elements of a professional negligence, medical malpractice, or elder abuse cause of action, and common themes and theories of nursing home litigation.
  2. Assess the merits of a nursing home lawsuit and/or regulatory action, including strengths and weaknesses of specific claims.
  3. Recognize and address pitfalls in nursing home practice to improve care processes, communication and documentation.
  4. Express the essential features of a qualified expert witness in nursing home civil or regulatory matters.

American Board of Post-Acute and Long-Term Care Medicine (ABPLM)(formerly AMDA)

This live activity has been pre-approved by the American Board of Post-Acute and Long-Term Care Medicine (ABPLM) for a total of 3.25 management hours toward certification as a Certified Medical Director (CMD) in post-acute and long-term care medicine. The CMD program is administered by the ABPLM. Each physician should claim only those hours of credit spent on the activity.

American Board of Internal Medicine MOC Statement

Successful completion of this activity enables the participant to earn 3.25 Practice Assessment points [and patient safety MOC credit] in the American Board of Internal Medicine’s (ABIM) Maintenance of Certification (MOC) program.
